L’auteur montre comment, en réaction à l’individualisme porté par le libéralisme, le juriste et sociologue Georges Gurvitch entend construire un droit social, essentiellement pluraliste, fondé sur des groupements constitutifs de formes de sociabilité : une telle réflexion lui semble rester d’actualité à l’heure du numérique et de la mondialisation.

The issue of knowing what it means for a group to have collective beliefs is being discussed more and more in contemporary philosophy of the social sciences and philosophy of mind. Margaret Gilbert’s reconsideration of Durkheim’s viewpoint in the framework of the plural subject’s account is one of the most famous. This has implications in the history and the sociology of science—as well asin the history and sociology of philosophy—although Gilbert only outlined them in the former fields and said nothing (...) about the latter. Symmetrically but independently, a historian of science, Mara Beller, has recently challenged Kuhn’s conception of the role of consensus in sciences in a brilliant analysis by carefully studying the history of Copenhagen School of Quantum Mechanics. Not only does she show the role of disagreement and controversies (doubting whether there was any collective belief characteristic in this group of physicists), but she even shakes up the very idea of individual beliefs. Each scientist (Heisenberg, Bohr, etc.) could be seen as divided into several selves. This paper contends that these two conceptions open important new horizons in several domains, especially if they are linked together. The paper assesses this claim in the light of empirical examples like the Vienna Circle, Copenhagen School, and, eventually, Cartesian philosophy. ABSTRACT Using the example of the Twitter feed #MeToo, this paper argues that CDS, in its task to understand more about how social media can offer ways for voices to challenge ideologies from below, needs to explore the ideas of ‘nodes’. Though #MeToo did provide an ideological challenge, I show how it is also discursively chaotic and partly driven by influencers who (...) may have a range of other motivations to align with the moral capital in the feed. At another level, #MeToo is highly nodal in terms of affect and moral conviction. These features can be understood in regard to nodal power of affective connectivity. Gilbert (2000) examined the issue of collective intentionality in science. Her paper consisted of a conceptual analysis of the negative role of collective belief, consensus, and joint commitment in science, with a brief discussion of a case study investigated by Thagard (1998a, 1998b). I argue that Gilbert's concepts have to be refined to be empirically more relevant. Specifically, I distinguish between different kinds of joint commitments. I base my analysis on a close examination of Thagard's example, the discovery of Helicobacter (...) pylori, and two other historical cases involving the Copenhagen school of quantum mechanics and the Austrian school of economics. I also argue that it is difficult to fulfill the condition of common knowledge, even in Gilbert's weak sense. I conclude by raising serious doubts about the very possibility of a certain type of joint commitment, which I refer to as an implicit joint commitment. (shrink)

The US and China have both benefited greatly from their trading relationship. However, motivated by a US concern that their partner was becoming more of a rival, then-president Donald Trump began a ‘trade war’ in 2018. In US news outlets and, of particular interest here, on American social media platforms, China was represented as a global menace, with extreme xenophobia against Chinese people. Yet less is known about how Chinese people responded on social media to the same situation. This paper (...) explores the discourses carried on the Chinese social media platform Weibo, focusing on the 2021 Alaska talks between the US and China, where negotiations took place. As with their US counterparts, Weibo users comment little on actual trade benefits or damages caused by the conflict. We find a strong sense of nationalism, but this is not based on xenophobia; rather on a discourse comparing the talks to similar events early in the twentieth century, where the ‘Century of Humiliation’ began, and where territories such as Hong Kong, Taiwan and Shaoshan were taken by colonial powers. Foregrounded is China’s ability now to end this humiliation. (shrink)

In this article, I examine the legal position of those who perform caregiving work within the context of a cohabiting relationship through a novel relational vulnerability lens. I argue that the state, through privatising and devaluing caregiving labour, situates carers within an unequal and imbalanced relational framework, exposing them economic, emotional, and spatial harms. Unlike universal vulnerability, which is inherent and unavoidable, relational vulnerability can be avoided and reduced if the state were to acknowledge that humans are embodied and relational (...) rather than self-sufficient and rational. Law’s treatment of cohabiting carers reflects the state’s broader tendency to value economic self-sufficiency, while confining caregiving to the private family. I argue that the state has a duty to respond directly to relational vulnerability and should aim to make cohabiting carers resilient. Resilience must involve the provision of material resources but should also have a normative commitment to achieving autonomy and equality for those marginalised by law and state policies. (shrink)

Some current attempts to go beyond the narrow scope of rational choice theory (RCT) in the social sciences and the artificial reconstructions it sometimes provides focus on the arguments that people give to justify their beliefs and behaviors themselves. But the available argumentation theories are not constructed to fill this gap. This article argues that relevance theory, on the contrary, suggests interesting tracks. This provocative idea requires a rereading of Sperber and Wilson's theory. Actually, the authors do not explicitly support (...) RCT, and Sperber has even strongly criticized methodological individualism, which most of the time underlies RCT, in favor of infra-individualism. A key point of the argument presented here is to show that Sperber and Wilson do not firmly distinguish between infra-individualism and subintentionality. Only subintentionality is needed. Dans cette contribution, j’examine la spécificité d’une perspective d’épistémologie sociale en théorie de l’argumentation en me livrant à une analyse critique de la théorie actuellement dominante dans ce champ, la pragma-dialectique de Franz van Eemeren. Cette perspective, d’inspiration interactionniste gricéenne, se réclame du « rationalisme critique », donc d’une perspective épistémologiquement « préservationniste » (au sens où elle préserverait l’idée de référence à des normes de la connaissance). Et pourtant, en faisant des normes du débat argumenté, y compris des normes (...) de la connaissance, de simples règles de « bonne conduite », elle témoigne, de facto, d’une position épistémologiquement « révisionniste ». Cette perspective manifeste, par ailleurs, une forme d’« expansionnisme » sociologique élémentaire, comme tel légitime si l’on considère qu’introduire deux sujets, c’est déjà introduire du social. La pragma-dialectique n’introduit pas de nouveaux sujets de connaissance sui generis, tels que les communautés épistémiques ou les institutions (ce qui serait pour Alvin Goldman le critère de l’expansionnisme, un critère à mon sens trop fort), mais comme il s’agit de rendre compte d’argumentations, elle doit envisager au moins deux interlocuteurs potentiels et donc dépasser le solipsisme épistémologique, une posture explicite chez Descartes et implicite dans la plupart des théories de la connaissance classiques, lesquelles font rarement réellement place à l’intersubjectivité. Malgré ses limites, la pragma-dialectique, par sa recherche de normes de la construction de la connaissance plus proches des processus effectifs ou naturels de la connaissance, pourrait constituer – épistémologiquement redressée – une contribution importante à une épistémologie sociale « naturalisée ». On se propose, dans cet article, de montrer l'intérêt de l'ouvrage classique de Richard H. Popkin du point de vue d'une analyse sociologique et anthropologique des processus collectifs de doute et d'adhésion. Un tel examen implique toutefois, au niveau de la méthode, d'analyser les différences fines existant entre histoire des idées, sociologie de la connaissance, ethnologie des croyances et épistémologie. L'examen mérite d'être mené aussi bien pour la compréhension du développement du scepticisme au XVIIe siècle que du déferlement de la (...) vague relativiste contemporaine, qu'il faut assurément distinguer, en suivant l'inspiration de Popkin, d'une forme de scepticisme modéré proche du rationalisme critique. El presente trabajo se ocupa de la teoría general de Carlos Nino sobre la legítima defensa y cómo ella se enmarca, de manera más general, en su concepción sobre el liberalismo en materia penal. Se muestran dos casos problemáticos para teorías así concebidas. Se propone una alternativa para salir de estos casos problemáticos apelando a consideraciones cercanas al ideal de no dominación. This paper analyses Carlos Nino’s general theory of legitimate defense and its relation with his conception about liberalism in (...) criminal law. There are at least two problematic cases for his theory of legitimate defense. La importancia de las ciencias naturales para la vida y el pensamiento contemporáneos es reconocida ampliamente. En ética y metaética la relevancia de las ciencias naturales se encuentra estrechamente vinculada con la concepción conocida como Naturalismo ético. A pesar de que existe una vasta literatura sobre Naturalismo y Naturalismo ético no es fácil encontrar un libro que recopile lo que diferentes autores relevantes tiene para decir sobre tal tópico. El libro Ethical Naturalism. Current Debates (2012) ha venido a llenar tal (...) laguna. Este trabajo presenta el tema general del libro y analiza y critica algunas de las ideas allí desarrolladas. El propósito central es hacer algunas observaciones generales a la empresa del Naturalismo ético considerado globalmente y al mismo tiempo algunas observaciones que son relevantes sólo para algunas de las intervenciones que forman parte de la colección. El positivismo jurídico como enfoque, en general, y el realismo jurídico en particular siguen al menos tres variantes filosóficas: el empirismo, el naturalismo y el pragmatismo. El realismo jurídico contemporáneo tiene múltiples variantes. Se habla de realismo norteamericano, escandinavo e italiano. Sin embargo, las corrientes del realismo jurídico no suelen seguir completamente a las teorías filosóficas. Más bien siguen algunas tesis, abandonan otras, y desarrollan algunas tesis propias complementarias. El presente trabajo se ocupa de una variante del realismo jurídico e (...) intenta mostrar que las tesis que éste movimiento sostiene generan numerosas tensiones. Lo que aquí se sostiene sobre el realismo analizado tiene relevancia, a su vez, sobre lo que se conoce como positivismo jurídico en cuanto enfoque. (shrink)

In 2016, following pandemic influenza threats and the 2014–2016 Ebola virus disease outbreaks, the WHO developed a guidance document for managing ethical issues in infectious disease outbreaks. In this article, we analyse some ethical issues that have had a predominant role in decision making in response to the current COVID-19 pandemic but were absent or not addressed in the same ways in the 2016 guidance document. A pandemic results in a health crisis and social and political crises both nationally and (...) globally. The ethical implications of these global effects should be properly identified so that appropriate actions can be taken globally and not just in national isolation. Our analysis, which is a starting point to test the broader relevance of the 2016 WHO document that remains the only available guidance document applicable globally, concludes that the WHO guidance should be updated to provide reasoned and thoughtful comprehensive ethics advice for the sound management of the current and future pandemics. Il n’est pas toujours évident de rappeler aujourd’hui que l’économie politique contemporaine est née d’une fusion, et non seulement d’évictions successives, entre le formalisme moderne, des conceptions non formalisées – et peut-être dûment impossibles à formaliser – mais rationnelles, et des intuitions dont le statut philosophique a été – et demeure – l’une des grandes questions traitées en théorie de la connaissance, telle que l’a en particulier illustrée la tradition allemande depuis Kant jusqu’à nous. Une des tentatives majeures pour donner (...) un statut à l’Anschauung dans la théorie économique a été conduite en Allemagne, puis en Suisse, par Edgar Salin (1892-1974) dont l’œuvre, fut inspirée par l’atmosphère régnant dans le cercle réuni autour du poète Stefan George dans l’Entre-deux guerres. Elle se présenta comme une conception alternative à celles de Popper et de Weber, tant quant à l’usage possible de l’intuition en regard du cadre de la rationalité scientifique qu’eu égard à l’architectonique et aux visées de l’économie politique. La présente étude restitue, d’une part, une brève généalogie du concept philosophique d’intuition et, d’autre part, constitue un des rares exposés en français de la doctrine développée par Salin, une pensée que le travail mené par les auteurs les a conduits à revaloriser dans l’optique d’épistémologie comparative qu’ils ont ici adoptée. Le rapport entre positif et normatif est une question méthodologique et théorique centrale en économie. À ce titre, les débats de la littérature spécialisée réclament une synthèse précise, à défaut de la cartographie exhaustive qui paraît une gageure. Le présent ouvrage le reconnaît volontiers en montrant qu'il est pertinent de revenir sur ces enjeux et qu'il est opportun d'élaborer ou d'ouvrir certaines perspectives jusqu'ici peut-être moins explorées. Le point de vue des coordinateurs de ce volume part du constat que l'étude (...) du rapport entre positif et normatif reste précieuse pour la pensée et la philosophie économiques : l'enquête met en évidence des distinctions essentielles, entre normes, valeurs et faits, ou entre l'activité de description, la prescription et l'évaluation, et concernant des notions comme la causalité dans le champ épistémique, la justice et l'intérêt dans le champ éthique. S'ajoutent des leçons instructives pour penser le rapport entre positif et normatif en défendant la primauté de l'un (le positif, le plus souvent) ou de l'autre (le normatif, plus rarement), ou en les séparant. Force est de constater que les écoles de pensée les plus divergentes peuvent se rejoindre, voire s'accorder sur des positions inattendues. Favoriser le positif, voilà qui réunit des économistes d'écoles de pensée aussi influentes et diverses que les écoles marxiste, autrichienne ou de Chicago : celles-ci, et d'autres, trouvent leur place dans ce volume, ainsi que des approches méthodologiques variées (pragmatisme, bayésianisme, théorie des négociations). S'il semble qu'un consensus valorisant les approches positives en économie y obère la recherche, à quoi est-il dû?? L'histoire de la pensée économique permet-elle de dégager quelques positions venant nuancer cette position?? Des perspectives philosophiques peuvent être adaptées à cet effet et l'importance des pratiques est également à relever, peut-être pour mieux valoriser les approches normatives en économie.Telles sont quelques-unes des approches traitées dans les onze contributions réunies dans cet ouvrage à partir d'un colloque tenu en décembre 2020. Building on contemporary research in embodied cognition, enactivism, and the extended mind, this book explores how social institutions in contemporary neoliberal nation-states systematically affect our thoughts, feelings, and agency. Human beings are, necessarily, social animals who create and belong to social institutions. But social institutions take on a life of their own, and literally shape the minds of all those who belong to them, for better or worse, usually without their being self-consciously aware of it. Indeed, in contemporary neoliberal societies, (...) it is generally for the worse. In The Mind-Body Politic, Michelle Maiese and Robert Hanna work out a new critique of contemporary social institutions by deploying the special standpoint of the philosophy of mind—in particular, the special standpoint of the philosophy of what they call essentially embodied minds—and make a set of concrete, positive proposals for radically changing both these social institutions and also our essentially embodied lives for the better. What is given to us in conscious experience? The Given is an attempt to answer this question and in this way contribute to a general theory of mental content. The content of conscious experience is understood to be absolutely everything that is given to one, experientially, in the having of an experience. Michelle Montague focuses on the analysis of conscious perception, conscious emotion, and conscious thought, and deploys three fundamental notions in addition to the fundamental notion of content: the (...) notions of intentionality, phenomenology, and consciousness. She argues that all experience essentially involves all four things, and that the key to an adequate general theory of what is given in experience lies in giving a correct specification of the nature of these four things and the relations between them.
